Fair Use & Usage Policy
Effective date: October 29, 2026
Last updated: October 29, 2026
This Fair Use & Usage Policy explains how BCM Navigator expects customers to use the client portal and related specialist-guided services responsibly and fairly. It supplements the Terms of Service and Refund & Cancellation Policy. If there is a conflict, the Terms of Service and applicable subscription arrangement govern.
Accounts and payments open at Soft Launch. This policy describes the service as it will work from then.
1. One Product, Plans by Paid Users, and One Organization
BCM Navigator is one product with the same full platform on every plan and under monthly, quarterly, and annual billing. Each subscription covers one named legal organization, one dedicated Tenant Knowledge Base, and every specialist agent as it launches. Plans differ only by the number of paid users: Professional (1 paid user), Enterprise Entry (5 paid users), Enterprise Mid (10 paid users), and Enterprise Top (25 paid users).
Every workspace also includes up to 20 free Sponsors and Viewers combined and unlimited guest Contributors. Consultants buy a plan for each client organization they serve.
Access to the specialist agents supports legitimate resilience work. It does not authorize credential sharing, unauthorized users, use of one subscription for multiple organizations or clients, automated abuse, or activity that materially disrupts the service or other customers.
2. Ordinary Professional Use
BCM Navigator is designed for ordinary professional work such as working through specialist-guided resilience workflows; answering interview prompts and asking relevant questions; reviewing, submitting, or uploading documents for supported assessment; developing and revising organizational context; generating, reviewing, and improving reports, plans, and other deliverables; returning to work across sessions; and undertaking substantial or intensive resilience work for the named organization.
A substantial project, a large amount of legitimate organizational work, or frequent use of relevant specialist workflows is not automatically a violation of this Policy. BCM Navigator will not treat ordinary paid use as unfair merely because the customer is actively developing or improving a meaningful resilience program.
3. Responsible Use of Content and the Tenant Knowledge Base
The customer and its users must have the rights, permissions, authority, and lawful basis needed to submit information, documents, organizational context, and other content for processing.
Customers must not submit unlawful, infringing, malicious, harmful, or unauthorized material; introduce code intended to compromise the service; or use the Tenant Knowledge Base to store or process information for an organization or client that is not the named organization under the subscription.
Customers remain responsible for reviewing, validating, approving, and using outputs appropriately. AI-assisted outputs do not remove the customer’s responsibility for professional judgment, confidentiality, legal compliance, or organizational decisions.
4. Credentials and Authorized Access
Sign-in credentials are per person: each person uses their own account, and credentials are never shared. The customer must take reasonable steps to protect credentials, prevent unauthorized access, and notify BCM Navigator of suspected account compromise or misuse.
A customer must not access another customer’s account, Tenant Knowledge Base, documents, workflows, outputs, or other information, whether directly or through an automated method.
5. Prohibited or Abusive Activity
The following activities are not fair use:
- using the service for multiple organizations or clients outside the named organization’s subscription
- sharing credentials or permitting unauthorized users to access the service
- bulk automation, scraping, crawling, probing, or repeated scripted requests that are not reasonably required for an approved workflow
- attempting to bypass authentication, access controls, rate controls, security measures, or other service safeguards
- repeatedly sending substantially duplicative requests in a manner designed to consume service capacity rather than perform legitimate work
- reverse engineering, copying, extracting, or republishing the service or its protected content without authorization
- introducing malware, malicious code, harmful files, or security-testing activity without written authorization
- using the service for unlawful activity, fraud, harassment, abuse, or infringement
- activity that materially disrupts availability, reliability, security, or access for BCM Navigator or other customers
This list does not prohibit legitimate document review, repeated improvement of a deliverable, iterative resilience analysis, or other substantial professional work that is reasonably connected to the named organization’s resilience objectives.
6. Proportionate Usage Management and the AI Usage Allowance
BCM Navigator may review activity when there is a reasonable basis to believe that it involves unauthorized access, prohibited automation, security abuse, unlawful content, use across unapproved organizations, or material disruption.
Where reasonably safe and practical, we will normally contact the workspace Owner to explain the concern and provide an opportunity to correct it. The customer should cooperate promptly, stop the relevant activity, secure compromised credentials, or explain the legitimate business purpose of the activity.
Access to the specialist agents is subject to responsible use and to the AI usage allowance below. It is not a guarantee of unlimited automated requests, document processing, or storage.
Each workspace has a monthly fair-use AI allowance that scales with its plan (Professional, Enterprise Entry, Enterprise Mid, and Enterprise Top). Usage is measured in the cost of the AI processing the workspace uses and is shown only as a percentage of the allowance, never as a number of interactions. AI work started by the Owner and Members counts toward the allowance; Sponsors, Viewers, and Contributors use none of it.
The allowance is rationed over three rolling windows, each a share of the monthly allowance: the last 24 hours (20%), the last 7 days (50%), and the calendar month (100%). Warnings are shown in the portal, and emailed to the Owner, at 80%, 90%, and 95% of each window.
When any window reaches 100%, new AI work stops until that window resets or the plan is upgraded. There is no slowdown, no switch to a cheaper AI model, and never an automatic overage charge. AI work already in progress finishes, and every feature that does not use AI, such as reading, editing, uploading, exporting, and approving, keeps working.
7. Urgent Security or Unlawful-Use Situations
Where activity presents an immediate security risk, threatens other customers, involves suspected unlawful conduct, or materially disrupts service availability, BCM Navigator may take proportionate protective action consistent with the Terms of Service and applicable law. Notice or an opportunity to correct may not be practical before urgent protective action.
This Policy does not promise a particular suspension, termination, refund, data-deletion, appeal, or restoration procedure. Any such action is governed by the Terms of Service, the applicable subscription arrangement, the Privacy Policy, the Refund & Cancellation Policy, and applicable law.
8. No Separate Billing-Duration Entitlements
Monthly, quarterly, and annual billing schedules do not create separate fair-use entitlements or separate usage allowances. The AI usage allowance is monthly on every billing schedule: quarterly and annual subscribers receive the monthly allowance each month, and unused allowance does not carry over. The same fair-use expectations apply to each schedule because each provides the same complete BCM Navigator product.
9. Questions About Unusual Activity
Ordinary document assessment, iterative specialist workflows, and substantial legitimate resilience projects do not require advance approval.
Before beginning unusual automated or high-volume activity that may affect service capacity or security, contact BCM Navigator at teodolfo@bcmnavigator.com with a description of the intended use. This request is for unusual automated or high-volume activity; it is not a requirement to obtain approval for ordinary professional use. A contact request does not itself authorize the activity, and customers remain responsible for complying with the Terms and this Policy.
10. Policy Changes
BCM Navigator may update this Policy when operational controls, service functionality, legal requirements, or customer arrangements change. An updated Policy will show a revised effective date.
